This Puppy Purchase Agreement (“Agreement”) is made between Cream Dachshund LLC, a California limited liability company (“Cream Dachshund”), and the individual purchasing the puppy pursuant to this Agreement (“Customer” and collectively, with Cream Dachshund, the “Parties”) for the purchase of the puppy identified by the Parties (the “puppy”). The customer may also purchase products for the puppy (“Products”). This Puppy Purchase Agreement is for all states EXCEPT California (California T&Cs).
The puppy is sold as-is, and, other than as expressly set forth herein below in the Health Commitment section, the terms of which are incorporated herein by reference and are made a part of this Agreement, Cream Dachshund makes no representations, warranties, covenants, agreements, or guarantees, including, without limitation, those relating to disposition, conformation, size, weight, color, or markings of the puppy.
The following terms and conditions also apply to your purchase of the puppy from Cream Dachshund:
NOTICE: THIS AGREEMENT INCLUDES A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER, SET FORTH BELOW, WHICH AFFECT YOUR RIGHTS. PLEASE READ IT CAREFULLY.
The value of the puppy for all purposes of this Agreement and Cream Dachshundâs Health Commitment is limited to the purchase price of the puppy (the “Purchase Price”) and does not include, as applicable, applied store credit, taxes, shipping costs, health certificate, veterinarian costs, shipping crate, or any additional costs or expenses incurred or asserted by Customer in connection with the puppy.
All puppies are sold as pets. The customer agrees and acknowledges that the customer will not breed the puppy. Customer agrees to spay or neuter the puppy at an appropriate age, as determined in consultation with the customer’s veterinarian. The customer further agrees to care for the puppy in a humane and responsible manner, including, but not limited to, providing it with clean and adequate shelter, food, water, and veterinary care. The customer agrees that the puppy shall reside inside his or her home, shall not be allowed to roam freely, and shall wear a collar with identification tags and any required license tags at all times.
Following is Cream Dachshundâs Code of Conduct:
Lifelong care of the dog. This means committing to the relationship for your dogâs entire life.
Choose a dog and breed that aligns with your home and lifestyle, avoiding hasty decisions. Be aware of common health problems associated with individual breeds, how to prevent them, and how to recognize their onset. Ensure that your housing rules allow for dog ownership.
Recognize that owning a dog requires an investment of time and money. Keep only the type and number of dogs for which you can provide a healthy, positive, and safe environment, including appropriate food, water, shelter, health care, bathing, grooming, and companionship.
Purchase food, treats, a collar and leash, toys, grooming tools, and other supplies in advance for a smooth transition into your home.
Decide who in your household is responsible for food, water, walks, exercise, cleanup, and grooming.
Remove breakables or âchewables,â make electrical cords inaccessible, and block off off-limits areas.
Ensure your yard is secure or provide a run. Puppies must be on a leash outdoors.
Keep your dog safe in the car with a crate or seat belt harness.
Create a comfortable area for rest or privacy.
Ensure socialization and appropriate training for your dog(s).
Prevent your dog from negatively impacting other people, animals, and the environment. This includes proper waste disposal, noise control, and preventing dogs from straying.
Provide frequent exercise and mental stimulation appropriate to age, breed, and health status.
Establish and maintain a veterinarian-client-patient relationship. Set up vaccinations and check-ups, and give the vet copies of the dogâs health records.
Provide preventive and therapeutic health care for the life of your dog(s) in consultation with your veterinarian.
Ensure dogs are properly identified (tags or microchips) and registration information is up-to-date.
Adhere to all laws, regulations, and ordinances, including licensing and leash requirements.
Help manage overpopulation by controlling reproduction through spaying/neutering.
Plan for emergencies or disasters, including assembling an evacuation kit and arranging care if you are unable to do so.
Recognize declines in your dog’ quality of life and make decisions in consultation with your veterinarian regarding appropriate end-of-life care.
Registration papers will only be sent for registered puppies and may not be sent until such time as the puppy has been spayed or neutered. Registration papers for all registered puppies will be sent by regular mail typically within two to four weeks of Cream Dachshund receiving confirmation of spay or neuter and could take up to six months. Any costs to obtain new or renewal registration papers are the sole responsibility of the customer. If the papers are lost, Cream Dachshund will assist the customer in obtaining new papers at the customer’s expense.
Cream Dachshund makes every commercially reasonable effort to provide accurate and up-to-date information on the Cream Dachshund website (the “Website”) regarding puppies sold through Cream Dachshund’s network. Such information includes, but is not limited to, breed, gender, color, date of birth, weight, parents’ weights, and registration details. Cream Dachshund relies on its network of breeders to accurately post puppies on the Website and is not responsible for typographical or photographic errors.
The puppy will typically travel within 2â3 weeks of the effective date of this Agreement. Occasionally, a puppy may need additional time with its breeder before travel. The final determination of the travel date for the puppy is made by the puppy’s breeder and the breeder’s veterinarian, with the health of the puppy being the primary determining factor.
Transportation of the puppy is generally arranged through Cream Dachshund and may include third parties in both arranging and delivery. Occasionally, there may be delays for reasons including, but not limited to, weather, temperature restrictions, logistics, mechanical failure, or other unforeseen events. Cream Dachshund shall not be liable, directly or indirectly, for any delays, including those that may cause Customer inconvenience or financial loss, nor shall any delay be a valid cause for cancellation of Customer’s purchase of the puppy.
Customer understands and agrees that no refund shall be provided by Cream Dachshund and/or its affiliated breeders due to any airline/airport delays or cancellations of the puppy’s flight, whether domestic or international. Customer is solely responsible for any required documentation, health reports, or vaccinations necessary to transport the puppy into any country other than the United States or Canada.
Until Customer has received confirmation from Cream Dachshund or the puppy’s breeder regarding the puppy’s delivery date, Customer may cancel the purchase by notifying Cream Dachshund. In the event of cancellation, an administrative fee schedule will apply:

* Total invoice refers to Puppy, Travel, Health Certificate, and additional products purchased with your puppy, like PupPack or any AKC packages. Calculation does not include taxes or discounts.
** Customer will have any taxes paid on invoice items not received returned to them.
Cream Dachshund disclaims any and all implied warranties of merchantability and fitness. Cream Dachshund further specifically disclaims any liability related to appearance, temperament, personality, size, weight, color, compatibility with breed standards, or DNA test results of any puppy. Cream Dachshund does not warrant the accuracy or completeness of Products.
While each Cream Dachshund puppy undergoes a Nose-to-Tail exam for the Health Certificate, many common conditions still permit a puppy to travel. Conditions listed below may be Normal for Breed or covered under our Health Commitment if present upon arrival:

For serious health items, Cream Dachshund will make every reasonable effort to contact Customer and discuss options. For more information on common puppy health conditions, please read our Help Center.
Cream Dachshund will not accept returns of the puppy for monetary refund for any reason, including allergies, landlord restrictions, marital issues, puppy adjustment problems, or any other reason. Puppies need time to adjust to their new surroundings. If Customer has concerns about adjustment, contact Cream Dachshund for guidance before deciding the puppy is not working out.
If Customer is unable or unwilling to care for the puppy at any time during the puppyâs life, Customer agrees to contact Cream Dachshund immediately regarding rehoming. Any return will be on a surrender basis only, with no refund or credit, and Customer is responsible for all travel-related costs. Cream Dachshund will use commercially reasonable efforts to find a new home through its proprietary rehoming program.
Different breeds have unique physical and temperament characteristics. Customer is strongly encouraged to research the breed, including using the American Kennel Club directory: https://www.akc.org/dog-breeds/
Brachycephalic Breeds (Flat-Faced Dogs)
These breeds have shortened skull bones giving a pushed-in appearance. Care includes walking during cool times and preferably using a harness. Travel restrictions may apply for brachycephalic breeds. Examples include:

By signing, you allow PuppySpot, AKC, and affiliates to contact you via phone/text, including automated calls or prerecorded messages.
Calls/texts may relate to completing purchases or informing about products/services.
Consent is optional and not required to make a purchase.
You may also contact AKC directly for registration or services independently.
Disputes must go to arbitration via the American Arbitration Association (AAA); no court trial or jury.
No class actions are allowed; claims must be individual.
Arbitration rules:
Governed by the Federal Arbitration Act.
Single arbitrator licensed to practice law.
Desk arbitration (document-only) unless a hearing is requested.
Hearings in Broward County, Florida, unless AAA decides otherwise.
Small claims in Broward County are allowed.
Costs for enforcing arbitration go to the breaching party.
If arbitration is unenforceable, litigation is limited to courts in Broward County, Florida.
Florida law governs this agreement, without applying other statesâ conflict-of-law rules.
If any clause is invalid, the rest of the agreement remains enforceable.
This document represents the full agreement between the parties; no other terms apply.
Owning a puppy requires regular vet visits; costs are your responsibility.
Puppies are checked by a vet before delivery; health commitment requires pet insurance for the first 12 months.
Coverage:
Days 1â14: Contagious diseases, illness, or parasites â reimbursement up to the puppyâs purchase price.
Year 1: Congenital/hereditary conditions â reimbursement up to purchase price.
Years 2â10: Hereditary/congenital conditions (except Bulldogs) â partial reimbursement or credit.
Exclusions:
Routine care, injuries, behavior, appearance, hip dysplasia in prone breeds if overweight, genetic tests, certain breed-specific issues (e.g., Bulldogs), hypoglycemia, and other specifics detailed in the policy.
Maintain pet insurance for 12 months; failure voids health commitment.
Regular vet visits with records.
Initial vet visit recommended soon after arrival.
Avoid over-vaccination, dog parks until fully vaccinated, provide proper diet, exercise, and spay/neuter.
Follow feeding and care instructions to avoid hypoglycemia.
Notify PuppySpot via email or phone.
Two methods:
Method One: Covers minor/short-term issues with invoices.
Method Two: Covers hereditary/congenital issues; must go through pet insurance first.
Only the original purchaser may file a claim.
State laws may provide additional rights.
Health claims disputes fall under the arbitration & Florida law clauses in sections 13 and 14.
